1. Introduction

These Terms of Service ("Terms") govern your use of ClaimX (accessible at claimx.co.za), a tax preparation platform operated by KTH Tech (Pty) Ltd ("we", "us", "our"), a company registered in the Republic of South Africa. By accessing or using ClaimX, you agree to be bound by these Terms. If you do not agree, you must not use the platform.

2. Important Disclaimer

ClaimX is a tax PREPARATION tool only. We are not a registered tax practitioner, tax advisor, or financial advisor as defined under the Tax Administration Act 28 of 2011 or the Financial Advisory and Intermediary Services Act 37 of 2002. ClaimX assists you in organising, calculating, and preparing your tax return — it does not file returns on your behalf, nor does it provide personalised tax advice. You remain solely responsible for the accuracy and submission of your tax return to SARS.

2A. No Guarantees

ClaimX makes no guarantees of any kind. Without limiting the generality of the foregoing:

No guarantee of refunds or outcomes. Any refund figures, estimates, or savings shown by ClaimX (including the refund estimator on our website) are indicative calculations only, based on the information you provide and published SARS tables. Your actual tax position is determined solely by SARS upon assessment. We do not guarantee that you will receive any refund, deduction, or tax outcome.
No guarantee of accuracy or completeness. While we take care to align our calculations with current South African tax legislation, we do not warrant that any output, categorisation, source-code mapping, or calculation is accurate, complete, or suitable for your circumstances. All outputs must be verified by you or a qualified tax professional before submission.
No guarantee of SARS acceptance. We do not guarantee that SARS will accept any return, deduction, or supporting documentation prepared with the assistance of ClaimX.
Service provided "as is". ClaimX is provided "as is" and "as available", without any express or implied warranty of merchantability, fitness for a particular purpose, or non-infringement, save for any warranties that cannot be excluded under the Consumer Protection Act 68 of 2008.

3. Eligibility

To use ClaimX, you must:

Be at least 18 years of age or have parental/guardian consent
Be a South African taxpayer or resident for tax purposes
Provide accurate and complete information
Have the legal capacity to enter into a binding agreement

4. User Responsibilities

When using ClaimX, you agree to:

Provide accurate, truthful, and complete information and documents
Verify all calculations and outputs before submitting any return to SARS
Keep your account credentials secure and confidential
Not use the platform for any unlawful purpose, including tax evasion or fraud
Not attempt to reverse-engineer, copy, or redistribute any part of the platform
Comply with all applicable South African laws and regulations

You acknowledge that you are solely responsible for the accuracy of the information you provide and the tax return you ultimately submit to SARS.

5. Acceptable Use

You may not use ClaimX to:

Upload malicious files, viruses, or harmful code
Attempt to gain unauthorised access to the platform or its systems
Scrape, crawl, or harvest data from the platform
Impersonate another person or entity
Use automated tools or bots to interact with the platform without our consent
Circumvent any security measures or access restrictions

6. Intellectual Property

All content, features, functionality, trademarks, logos, and design elements of ClaimX are the exclusive property of KTH Tech (Pty) Ltd and are protected by South African intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any part of the platform without our prior written consent.

Your uploaded documents and personal data remain your property. By uploading content to ClaimX, you grant us a limited, non-exclusive licence to process that content solely for the purpose of providing the tax preparation service.

7. Service Availability

We strive to maintain ClaimX's availability but do not guarantee uninterrupted or error-free service. We reserve the right to:

Perform scheduled maintenance with reasonable notice
Modify, suspend, or discontinue any feature of the platform
Restrict access during periods of high demand (e.g., filing season)

8. Fees and Payment

ClaimX operates on a once-off payment model per tax year. There are no recurring subscriptions or automatic renewals. Current pricing is displayed on the platform. All prices are in South African Rand (ZAR) and include VAT where applicable. Payments are processed through Paystack, a licensed payment gateway operating in South Africa. By making a payment, you agree to the respective payment processor's terms. All sales are final — no refunds are offered.

9. Limitation of Liability

To the maximum extent permitted by South African law, including the Consumer Protection Act 68 of 2008 and the Electronic Communications and Transactions Act 25 of 2002:

KTH Tech (Pty) Ltd shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of ClaimX
We are not liable for any penalties, interest, or additional tax assessed by SARS as a result of information you provided or decisions you made using the platform
Our total liability for any claim shall not exceed the amount you paid for the service in the 12 months preceding the claim
We are not responsible for any loss resulting from your failure to verify calculations or outputs

10. Indemnification

You agree to indemnify and hold harmless KTH Tech (Pty) Ltd, its directors, employees, and agents from any claims, losses, damages, or expenses (including legal fees) arising from your use of ClaimX, your breach of these Terms, or your violation of any law.

11. Termination

We may suspend or terminate your access to ClaimX at any time if you breach these Terms or engage in prohibited conduct. You may terminate your account at any time by contacting enterprise@kth-tech.com. Upon termination:

Your right to access the platform ceases immediately
We will retain your data for the legally required retention period (5 years for tax records)
As a once-off purchase, no refunds are issued upon termination

12. Dispute Resolution

Any dispute arising from these Terms shall be resolved as follows:

Negotiation: The parties shall first attempt to resolve the dispute through good-faith negotiation within 30 days
Mediation: If negotiation fails, the dispute shall be referred to mediation in accordance with the rules of the Arbitration Foundation of Southern Africa (AFSA)
Litigation: If mediation fails, either party may institute proceedings in the High Court of South Africa, Gauteng Division, Pretoria

13. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of South Africa. You consent to the exclusive jurisdiction of the courts of the Gauteng Division of the High Court of South Africa for any legal proceedings arising from these Terms.

14. Amendments

We reserve the right to amend these Terms at any time. Material changes will be communicated via email or a prominent notice on the platform at least 14 days before taking effect, as required by the Electronic Communications and Transactions Act 25 of 2002. Your continued use of ClaimX after the effective date constitutes acceptance of the amended Terms.

15. Consumer Protection

Nothing in these Terms limits or excludes any rights you may have under the Consumer Protection Act 68 of 2008 or any other applicable South African consumer protection legislation. Where these Terms conflict with the CPA, the provisions of the CPA shall prevail.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
